Last night a panel of three judges from the 9th Circuit Court listened to arguments from lawyers on both sides of Trump’s immigration ban.
The judges pressed Trump’s DOJ lawyers on whether the executive order was discriminatory or not, and pressed lawyers for Washington state and Minnesota on why it is unconstitutional for a president to determine countries as dangerous and bar people from them.
The US Constitution does give the president the authority to bar entry of any class of aliens that the president deems dangerous and detrimental to the U.S. — But the Constitution also says the U.S. can’t make any laws that prioritizes or discriminating a religion.
Trump’s executive order did not mention a religion, but lawyers have used Trump’s previous statements about suspending entry of Muslims and tied it with the fact the seven countries have a Muslim majority.)
The ban is currently not enforced because of the federal judge from Seattle — Judge Robart’s order. The 9th circuit judges are still deliberating the decision, it could be today or later this week.
President Trump has continued to ramp up strong criticism and attacks against a potential decision against his executive order both on Twitter and during his speech this morning to an audience of police chiefs in D.C.
Trump said the judges should obviously side with the White House, that a bad high school student would understand this.

We’re all waiting for the three judges’ decision, it will have a huge impact either way.
